Defendant Sentenced for Shooting at Liquor Store

The Honorable Kevin McCormick sentenced Emmanuel Pacheco to 22 years in state prison.  On March 23, 2022, a jury convicted Pacheco of assault with a semi-automatic firearm and felon in possession of a firearm. The jury also found true a personal use of a firearm allegation and aggravating factors that Pacheco engaged in violent conduct that indicates a serious danger to society; and the crime involved great violence, great bodily harm, threat of great bodily harm, or other acts disclosing a high degree of cruelty, viciousness, or callousness. The Court found true the allegation that Pacheco has a prior strike conviction for robbery.

On October 4, 2020, Sacramento sheriff’s deputies responded to reports of shots fired at a liquor store on Fulton Avenue. Deputies arrived on scene and found the victim in front of the store with a gunshot wound. The victim survived, but she was paralyzed from the waist down.  A witness described a van at the scene that sped away after the shots were fired.  Dispatch broadcast the shooting and description of the van. A Sacramento sheriff’s deputy saw the van and conducted a traffic stop on Eastbound Interstate 50 near Bradshaw. As soon as the van came to a stop, Pacheco jumped out of the van and hopped over the freeway railing. CHP Air units were already in the air and assisted the Sheriff’s Office in monitoring Pacheco until he was detained. Deputies located a 9mm Glock 17 with an extended magazine in Pacheco’s path when he fled, and a Gun Shot Residue Kit was collected from Pacheco.

Multiple witnesses identified Pacheco as the shooter. The District Attorney’s Crime Lab confirmed the presence of gunshot residue on Pacheco and ballistics testing confirmed that all 27 shell casings found at the crime scene were from the Glock 17 that was recovered. The gun was unregistered.
