The Sacramento County District Attorney’s Office is alerting the public to inmates who have been granted Elder Parole by the Board of Parole.

INMATE: David Funston 

CDCR: #P37790 

AGE: 64 

CASE: #96F00851 

CONVICTION: 16 Counts of Child Molestation, Sexual Assault, Kidnapping and Special Allegations. 

SENTENCE: Three consecutive terms of 25 years to LIFE 

TIME SERVED: 27 years 

PAROLE HEARING DATE: September 24, 2025 – GRANTED 

CASE SUMMARY: Funston’s victims included a 5-year-old girl he lured into his car with candy and drove away to a secluded area. He forcibly and violently sexually assaulted the girl. He also choked her when she initially refused, shoved her underwear into her mouth when she screamed, and punched her. Funston took a 4-year-old boy into some bushes and sexually assaulted him. Funston then lured a 4-year-old girl into his car with jewelry and toys and took her to a house.  He molested the victim and while holding a knife to her throat and threatening to kill her and her family if she told anybody.  

PRIOR HISTORY: At age 15, Funston molested a 6-year-old girl.  At age 22, he fondled a highly intoxicated female co-worker.  At age 23, he punched a woman in the face, breaking her nose.  At age 24, he dragged an intoxicated woman behind a building and chocked her, threatened to kill her and sexually assaulting her.  

RISK ASSESSMENT: The Risk Assessment states Funston is Moderate (Higher Moderate) risk for violence. Moderate-risk examinees are expected to commit violence more frequently than Low-risk long-term parolees but less frequently than other parolees. 

Funston was shown to meet the criteria for Pedophilic Disorder, sexually attracted to both and other personality disorders.
