Sacramento County District Attorney Thien Ho Announces Settlement with Raley’s for Unfair Business Practices
The Sacramento County District Attorney’s Office, in collaboration with the Yolo County District Attorney’s Office and three additional District Attorney’s offices, has reached a settlement with Raley’s supermarkets regarding the sale and offer for sale of expired over-the-counter (OTC) drugs. The judgment in case CV2025-1075 was filed in Yolo County Superior Court.
An unfair business practice investigation revealed that Raley’s offered expired OTC drug products for sale, in violation of a prior injunction addressing similar business activities filed in Sacramento in 2019. The investigation identified categories of OTC drugs not accounted for in Raley’s compliance program that were established under the prior matter, which led to this enforcement action.
Under the terms of the settlement, Raley’s will pay $278,000 in civil penalties and $111,000 in cost recovery. Sacramento County will receive $57,000 of the combined penalties and costs. Additionally, Raley’s will contribute $5,000 to Sacramento Food Bank and Family Services. These funds will be used to purchase products for distribution to families in need within Sacramento.
District Attorney Thien Ho stated, “This action will help ensure consumers get quality products with the maximum effectiveness they deserve when they purchase OTC drugs. Enforcing retailers’ compliance with product expiration laws is one more way our office is helping to protect the public’s health and safety.”
