Defendant Convicted of Rape, Assault to Commit Sexual Assault

Erick Brandon was convicted by a jury of forcible rape and assault with intent to commit rape/sodomy/oral copulation with aggravating factors found true. The jury also found true that Brandon has a prior strike conviction for carjacking and two prior strike convictions for robbery. Brandon had previously pled to felon in possession of a firearm.
The victim allowed Brandon to stay at her apartment until he was able to move into his own place. On February 7, 2023, Brandon entered the victim’s bedroom while she was sleeping and raped the victim as she continually told him “no.” As he left the room, he told her that he would be back to finish. On February 8, 2023, Brandon entered the victim’s bedroom again and attempted to sexually assault her. The victim was able to get to a place of safety and report the assaults.
Brandon faces a maximum sentence of 56 years to life in prison. Sentencing is set for February 16, 2024, at 9:00 a.m. in Department 32 before the Honorable James Arguelles.
