CASE: Roberto Lopez (Case #19FE009358)

Roberto Lopez was convicted by a jury of two counts of forcible lewd act upon a child under 14 years old and two counts of rape of a child under 14 years old by a perpetrator more than 10 years older than the victim.  The jury also found true that the victim was vulnerable and Lopez took advantage of a position of trust when he sexually assaulted the victim.

Lopez was a family acquaintance and father figure to the victim.  Lopez raped the victim when she was 12 years old, and again when she was 13 years old. The first rape occurred in Sacramento, the second rape occurred in Yuba City.  In both instances of rape, Lopez held the victim down and forced himself on her.  In the final incident which lasted longer than the first, he inflicted painful physical trauma to the victim which lasted for days.

An allegation that Lopez has a prior strike conviction for possession of drugs for sale for the purposes of a criminal gang and additional aggravated circumstances will be determined at the sentencing hearing.

Lopez faces a maximum sentence of 65 years to life in prison.  Sentencing is set for December 9, 2022, at 8:30 a.m. in Department 36 before the Honorable Stephen Acquisto.
