Defendant Convicted of Shooting, Killing Victim

Victor De La Rosa was convicted by a jury of the second-degree murder of Roy Jimerson.  The jury also found true the allegation that De La Rosa personally used a firearm causing death.

On February 22, 2020, De La Rosa got into a confrontation with the victim, who was a local transient, and a fight ensued.  After exchanging punches, De La Rosa continued to pursue the victim down a street and the two exchanged words.  De La Rosa then fired nine shots from his .45 caliber pistol, striking the victim five times.  The victim died two days later from a gunshot wound to the chest. De La Rosa threw the murder weapon that he lawfully owned in the river and lied to the police when confronted with surveillance footage from the incident. The weapon was never recovered.

De La Rosa faces a maximum sentence of 40 years to life in prison.  Sentencing is set for October 7, 2022, at 9:00 a.m. in Department 23 before the Honorable Curtis Fiorini.
