PROSECUTOR: Deputy District Attorney Cody Winchester, Career Criminal Prosecution Unit

Marcus Grey was convicted by a jury of attempted murder, shooting at an inhabited dwelling, assault with a semiautomatic firearm and possession of a firearm by a felon.  The jury also found true allegations of premeditation, use of a firearm, intentional discharge of a firearm causing great bodily injury and causing great bodily injury. Vincent Jones was convicted of attempted murder, shooting at an inhabited dwelling, assault with a semiautomatic firearm, unlawful possession of an assault rifle and three counts of possession of a firearm by a felon.  The jury also found true allegations of premeditation and principle armed with a firearm.

On October 23, 2020, Grey and Jones drove to a house in south Sacramento where Grey had previously lived. Grey was forcefully removed from the house over a dispute. The victim was sitting in the backyard of the house with his nieces and nephews when Grey fired 24 rounds into the backyard. Several rounds passed through the exterior wall of the house and into the living area.  The victim was hit twice, nearly killing him. After Grey completed the shooting, he ran back to the vehicle and fled the scene. Jones was the getaway driver.  During the investigation, text messages showed that Grey had attempted to get a gun from a friend prior to the shooting.  After the shooting, texts between Grey and Jones bragged about how they had “handled” the dispute. When the defendants were arrested in February 2021, Jones was found to be in possession of an illegal assault rifle, a stolen handgun and a handgun with the serial number shaved off. Both Defendants are validated gang members.

Grey admitted to a prior strike conviction for first-degree burglary. Jones has prior convictions for domestic violence and resisting arrest.

Grey faces a maximum sentence of 50 years to life in prison.  Jones faces a maximum sentence of 11 years and 4 months to life in prison.  Sentencing is set for June 24, 2022, at 1:30 p.m. in Department 40 before the Honorable Steve White.
