DATE: May 20, 2022

CASE: David Capps (Case #18FE016564)

PROSECUTOR: Deputy District Attorney Quirina Orozco, Special Assault & Child Abuse Unit

The Honorable Steve White sentenced David Capps to 39 years in state prison.  On March 24, 2022, Capps pled guilty to nine counts of child sexual assault. The case continued to a jury trial on the remaining counts.  On March 28, 2022, a jury convicted Capps of all remaining charges of domestic violence causing great bodily injury, assault with a shotgun and assault with a knife.

On August 19, 2018, Elk Grove police officers responded to a call and found Capps and the victim at the scene.  Officers learned that Capps held a shotgun to the victim’s head and told her it was loaded.  He also held a knife to the victim’s throat and threatened to kill her. The victim stated that Capps had strangled her to the point of near unconsciousness. Doctors later diagnosed the victim as having suffered a fractured larynx as a result of the strangulation.  During the investigation, detectives discovered that Capps sexually assaulted a child when she was 7 to 11 years old.
