The Honorable Timothy Frawley sentenced Damien Tardy to 32 years to life in prison. On July 26, 2017, a jury convicted Tardy of attempted murder. The jury also found true the allegations that Tardy intentionally discharged a firearm causing great bodily injury, and that the offense was committed willfully, deliberately and with premeditation.
Shortly after midnight on August 2, 2016, the victim met Tardy at a South Sacramento motel to purchase heroin. When the victim determined the heroin was poor quality, he went back to the motel to get his money back. The men then drove to the north area of Sacramento and purchased better quality heroin. After they sat in the car for a few minutes, Tardy said he had to get something out of the trunk and exited the car. When the victim exited the car, Tardy drew a gun and fired two shots, striking the victim in his head and neck. The victim fell to the ground and tried to crawl away from Tardy, who then fired several additional shots. The victim was struck twice in his torso and leg. Police were called to the scene and the victim was transported to a hospital where, after undergoing several surgeries, he survived.
