Defendants Convicted of Gang Related Shooting

CASE:  Justin Jorn & Terry Eales (Case #16FE010824)

PROSECUTOR:  Deputy District Attorney Kristen Andersen, Gangs & Hate Crimes Unit

Justin Jorn was convicted by a jury of shooting into an inhabited house, two counts of assault with a semi-automatic firearm, assault likely to cause great bodily injury, robbery, being a felon in possession of a firearm and numerous sentencing enhancements based on using a firearm, causing great bodily injury and committing those crimes in furtherance of a criminal street gang. Terry Eales was convicted of robbery, assault likely to cause great bodily injury and committing both of those crimes in furtherance of a criminal street gang. 

On May 18, 2016, Justin Jorn and Terry Eales approached the victim and told him he had to pay taxes to the Norteno gang for money he was making in the neighborhood. When the victim refused, Jorn assaulted him and Eales took the victim’s money and jewelry. The victim was knocked unconscious and found in an alley two hours later. When the victim was in the hospital, Jorn drove by the victim’s house and shot at two people while they were outside of the house.  The house was hit two times, fortunately no one outside or inside the house was struck by gunfire. 

An allegation that Jorn has a prior strike conviction for robbery will be determined at the sentencing hearing.  

Jorn faces a maximum sentence of 46 years and 4 months in prison.  Eales faces a maximum sentence of 15 years in prison.  Sentencing is set for February 21, 2020, at 9:00 a.m. in Department 20 before the Honorable Michael Sweet.
